Cancellations + Refunds
- Cancel in writing (email). Refund tiers by how far in advance you cancel.
- 150+ days: full refund. 60 days or less: no refund.
- If we cancel, we refund payments to us; other costs (e.g. airfare) are yours.
Weather + Itinerary Changes
- Itineraries are guidelines, not guarantees.
- Weather, wildlife, access, and safety can require changes.
- No discounts or refunds for activities impacted by circumstances beyond our control.
Safety + Liability
- You assume inherent risks of outdoor and travel activities.
- You release Nettelhorst Images, Inc. and associated parties from liability to the fullest extent permitted by law.
- You are responsible for your readiness, gear, and following safety guidance.

Nettelhorst Images, Inc. (“NI,” “we,” “us,” or “our”) operates Nettelhorst Photography and related sites, services, events, workshops, mentoring, and communications (collectively, the “Services”). By using our website(s) and Services, you agree to this Privacy Policy and our Terms & Conditions.

These Terms & Conditions (“Terms”) govern your use of our website(s) and participation in any workshops, outings, expeditions, photo tours, classes, mentoring, speaking programs, and related offerings (“Programs”). By using our website(s) or participating in a Program, you agree to these Terms.
Eligibility
Unless accompanied by a parent/legal guardian (and with our approval), you must be at least 18 years old to participate.
Assumption of risk and release of liability
Photography travel and outdoor activities involve inherent risks, including injury, illness, death, property loss/damage, acts of nature, and actions of others. You voluntarily assume all known and unknown risks and release Nettelhorst Images, Inc. and associated parties from liability to the fullest extent permitted by law.
Itineraries, flexibility, and changes
Program itineraries are guidelines, not guarantees. Weather, wildlife, access, permits, safety, and other factors may require changes. There are no discounts or refunds for activities impacted by circumstances beyond our control.
Participant responsibilities
- Study pre-trip information and arrive prepared.
- Bring appropriate gear/clothing.
- Act respectfully toward participants, guides, environments, and local rules.
- Follow wildlife ethics and safety guidance.
- We may remove a participant if their participation negatively affects safety or the group experience; related costs are the participant’s responsibility.
Rooming and single supplements (where applicable)
If you select double occupancy and we cannot match a roommate, you may be responsible for a single supplement charge (when applicable).
Travel documentation and insurance
You are responsible for passports, visas, identification, and required immunizations. We strongly recommend travel insurance and (for international travel) travel medical insurance.
What’s not included (unless explicitly stated)
Transportation, optional activities, gratuities (unless noted), passport/visa expenses, insurance, personal expenses, and items not explicitly listed as included.
Cancellation or change by us
We may cancel or change a Program due to insufficient bookings, safety, or circumstances beyond our control. If we cancel, we will refund payments made to us for the Program. Our liability is limited to the amount paid to us and does not extend to other costs you incur (airfare, separately booked lodging, equipment, insurance, etc.).
Cancellation and refund policy (participant)
Cancellations must be made in writing by emailing info@nettelhorstimages.com.
- More than 150 days before start: full refund of payments made
- 150–91 days: refund of payments made exceeding 50% of tuition
- 90–61 days: refund of payments made exceeding 75% of tuition
- Within 60 days: no refund
Some Programs may be non-refundable and will be clearly labeled. If we can fill your space, we will provide a 100% refund of payments made. Private/custom Programs arranged specifically for you are not refundable.
Use of name, likeness, and reviews
We may photograph/film during Programs and use resulting media for promotional purposes in print and electronic formats. If you prefer not to appear, notify the leader at the start of the Program. We may also use written reviews or behind-the-scenes photos you provide for promotional purposes without compensation.
Arbitration (Chicago, Illinois)
Any dispute relating to these Terms or a Program will be submitted to binding arbitration under the rules of the American Arbitration Association in Chicago, Illinois. You waive the right to bring an action before a judge or jury in court.
Website content and intellectual property
All site content (photos, video, text, branding, educational materials) is owned by Nettelhorst Images, Inc. or licensed to us and may not be copied, redistributed, or used commercially without written permission.
Purchasing prints, products, digital downloads, and licensing
Nettelhorst Photography may offer fine art prints, physical products, digital downloads, and/or image licensing (“Products”). By purchasing Products, you agree to the following:
All sales / product descriptions
Product images, sizes, crops, and colors may appear differently on different screens and printers. We make reasonable efforts to display Products accurately, but we cannot guarantee exact color matching or appearance.
Fulfillment and shipping
Shipping times are estimates and not guarantees. Title and risk of loss pass to you upon delivery to the carrier unless otherwise required by law.
Returns and exchanges (physical prints/products)
Unless otherwise stated on the product page, custom prints and made-to-order Products are generally not eligible for returns due to the nature of custom printing. If a Product arrives damaged or materially defective, you must notify us within 7 days of delivery with photos of the damage and packaging so we can evaluate and, where appropriate, issue a replacement or remedy.
Digital downloads
Digital Products are delivered electronically and are non-refundable once delivered or access is provided, unless required by law.
Licensing (what you are buying)
Purchasing a print or digital file does not transfer copyright. Any license granted is limited, non-exclusive, non-transferable, and revocable, and is only for the specific use described at the time of purchase. If you need commercial usage rights (advertising, packaging, brand campaigns, resale, etc.), you must obtain a written commercial license agreement from us.
Prohibited uses without written permission
You may not resell, sublicense, redistribute, or provide our images/files to third parties; remove metadata/watermarks; use images in trademarks/logos; use images for training AI models; or use images in a way that is defamatory, unlawful, or misleading.

Modern addendum (digital, payments, IP)
Digital Services (coaching, mentoring, online workshops)
- Scheduling details and what’s included will be described at purchase/registration.
- You are responsible for adequate internet/hardware and a suitable environment.
- No guarantees are made regarding results (portfolio, social growth, publication/awards, income, etc.).
Recording and session content
We may record sessions for quality control, training, or participant access where stated. If recording will occur, we will disclose it during the session or booking flow. If you do not wish to be recorded, notify us before the session begins (we may proceed without recording where feasible).
Rescheduling and no-shows (Digital Services)
- Reschedule requests must be made at least 48 hours before session start.
- No-shows or late cancellations may be treated as a forfeited session/credit.
- If we must reschedule, we will provide a comparable alternative time or credit.
Payments, subscriptions, failed payments, chargebacks
- You agree to pay all fees shown at checkout. Some Programs may require a non-refundable deposit (disclosed in the booking flow).
- If you enroll in a recurring plan/subscription, you authorize recurring charges until cancellation.
- If a payment fails, we may retry processing and/or suspend access until payment succeeds.
- If you initiate a chargeback/payment dispute, we may suspend access while it is investigated. Please contact us first to resolve at info@nettelhorstimages.com.
Your content and portfolio usage
If you submit images/videos for critique, you retain ownership. You grant us a limited license to display submissions for critique and teaching. If you do not want your work used publicly, notify us in writing.
DMCA / copyright reporting
If you believe content on our site infringes your copyright, email info@nettelhorstimages.com with identification of the work, the URL/location, your contact info, good-faith statement, accuracy statement under penalty of perjury, and your signature.
Acceptable use (website + communications)
You agree not to misuse the website or Services. This includes attempting to access systems without authorization, scraping content, interfering with site performance, uploading malicious code, harassing others, or using content in violation of intellectual property rights.
Limitation of liability
To the fullest extent permitted by law, Nettelhorst Images, Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunities, arising from or related to your use of the Services or participation in Programs, even if advised of the possibility of such damages.
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Services or Programs will not exceed the amount you paid to us for the specific Program or Product giving rise to the claim.
Indemnification
You agree to indemnify, defend, and hold harmless Nettelhorst Images, Inc., its officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your participation in Programs, (b) your violation of these Terms, (c) your violation of any law or third-party rights, or (d) your negligence or willful misconduct.
Force majeure
We are not responsible for delays, changes, interruptions, or cancellations caused by events beyond our reasonable control, including but not limited to: weather, natural disasters, wildfire, flood, pandemic, public health emergencies, acts of government, changes in laws or permits, labor disputes, transportation interruptions, equipment failures of third parties, or civil unrest. In such cases, our obligations may be suspended or modified as necessary for safety and practicality.
Governing law
These Terms are governed by the laws of the State of Illinois, without regard to conflict of laws principles, except where federal law applies.
Class action waiver (commonly paired with arbitration)
To the fullest extent permitted by law, you agree that disputes will be resolved only on an individual basis and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
Severability
If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be severed and the remaining provisions will remain in full force and effect.
Entire agreement
These Terms, together with any Program-specific terms provided to you in writing, constitute the entire agreement between you and Nettelhorst Images, Inc. regarding the Services and Programs and supersede any prior discussions or agreements on the subject.
Updates
We may update these Terms from time to time by posting an updated version on this page. The “Last updated” date will reflect the most recent revision. Continued use of the Services after updates constitutes acceptance of the updated Terms.

Each participant in a Nettelhorst Images, Inc. (“NI”) event must accept these terms in order to participate.
In consideration of the services of Nettelhorst Images, Inc., their officers, agents, employees, and all other persons or entities associated with those businesses (collectively “Nettelhorst Photography”), I agree as follows:
Although Nettelhorst Photography has taken reasonable steps to provide appropriate information and skilled coaches, I understand this activity is not without risk. Certain risks are inherent and cannot be eliminated without destroying the unique character of the activity. These risks may cause loss or damage to my equipment, injury, illness, permanent trauma, or death.
Outdoor & photographing activities
Inherent risks may be different or greater than those normally assumed at home or work. These risks include but are not limited to: inclement weather, slipping, falling from a height, insect/animal bites, being struck by falling objects, immersion in cold water, hypothermia, hyperthermia, uneven terrain, stream crossings, travel on active logging roads, social/economic losses, loss or damage of personal property (including vehicle), injury, permanent disability, or fatality.
Communication and emergency response times may be significantly longer than in urban settings.
I acknowledge the description above is not complete and that other unknown or unanticipated inherent risks may result in injury or death. I agree to assume and accept full responsibility for all inherent risks, whether known or unknown. My participation is purely voluntary.
I certify that I am fully capable of participating and assume full responsibility for myself (including any minor children in my care, custody, and control) for bodily injury, death, loss of personal property, and related expenses as a result of inherent risks and my own negligence.
I have carefully read, clearly understood, and accepted the terms and conditions stated herein and acknowledge that this agreement shall be effective and binding upon me, my heirs, assigns, personal representative, estate, and family members, including minor children.
Release and covenant not to sue
To the fullest extent permitted by law, I release and agree not to sue Nettelhorst Images, Inc. and its officers, employees, contractors, agents, and affiliates (“Released Parties”) for any and all claims, demands, causes of action, damages, losses, or liabilities arising out of or related to my participation in the activity, including claims caused by the negligence of the Released Parties, except to the extent prohibited by law.
Indemnification
I agree to indemnify and hold harmless the Released Parties from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to my acts or omissions, my violation of instructions or safety guidance, or my participation in the activity.
Medical care and emergency transport
If I require medical assistance, I authorize Nettelhorst Photography to obtain emergency medical treatment for me and/or arrange transportation, if deemed necessary. I understand that I am financially responsible for medical care and related transportation and that Nettelhorst Photography does not provide medical insurance coverage.
Minors (if permitted)
If minors are permitted for a specific Program, the parent or legal guardian must sign and agrees to all terms on behalf of the minor. The parent/guardian assumes all risks for the minor and agrees to release and indemnify the Released Parties to the fullest extent permitted by law.
Safety / medical addendum
- You are responsible for ensuring you are physically capable of participating (uneven terrain, heat/cold, altitude, water crossings, vehicle travel, limited emergency response).
- You authorize us to seek emergency medical treatment if necessary and accept financial responsibility for medical services and related transportation.
- You are responsible for your equipment at all times. We are not responsible for loss, theft, damage, weather exposure, or equipment malfunction.
Waiver acceptance
By registering for or participating in an event, I acknowledge and accept this waiver.
